The Office of the Registrar Environment and Land Court is established under Section 9 (1) of the Environment and Land Court Act No. 19 0f 2011.
The Registrar of the Environment and Land Court in Kenya oversees the overall administration of all the Environment and Land Court stations,
divisions and sub registries; and has several key responsibilities under the Environment and Land Court Act.
These include:
- Managing the Court Registry: Establishing and maintaining the Registry where all court documents are stored.
- Handling Documents: Accepting, transmitting, serving, and keeping custody of documents in accordance with court rules. This is to ensure a high level of efficiency is maintained for the sake of litigants and court users.
- Enforcing Court Decisions: Facilitating the enforcement of court orders and decisions.
- Certifying Court Orders: Officially certifying that orders, directions, or decisions are issued by the Court, Chief Justice, or a Judge.
- Maintaining Court Records: Keeping records of proceedings, minutes of meetings, and other relevant documents.
- Supervising Court Staff: Managing and overseeing the staff working within the court, and looking into staff development.
- Managing the Court Library: Overseeing the library and ensuring access to legal resources.
- Providing Access to Judgments: Facilitating public access to court judgments and records.
- Handling Procedural Matters: Addressing procedural or administrative matters for the Environment and Land Court including implementation of ELC activities such as Conferences, Workshops and stakeholder engagements.
- The Registrar performs such other duties as the Chief Registrar or the Principal Judge ELC may direct.
- The Registrar is assisted by Deputy Registrars, Assistant Deputy Registrars and judicial staff deployed in every ELC station countrywide.
These functions ensure the smooth operation of the Environment and Land Court and support its role in resolving disputes related to land and environmental matters.
