Privacy Policy Statement

This Privacy Statement outlines how the Judiciary through e-filing collects, uses, and protects any information you give the Judiciary when you use www.efiling.court.go.ke/ . 1.    What information do we collect and why?

The Judiciary collects identifying information from three user groups: individuals, organizations, and law firms This information is collected directly, when registering as a new user, filing documents, or contacting support, and indirectly from cookies and analytics tools, to gather data on how you use our portal. Details of the information collected, and how it is used is given below:

1.1.  Contact Information – To provide you with the services you requested or a particular query the Judiciary collects information including, but not limited to:

·       Name

·       Organization name

·       Company Registration Number

·       Law firm name

·       Law Firm Registration No

·       Contact details (e.g. postal address, email, telephone number)

·       Identification numbers, or other details you may provide

Contact information may be used periodically to send promotional emails about new products, special offers, or other information that we think you may find interesting. 

1.2.  Organization Profiles – Upon registration of a new user account, the Judiciary automatically creates a profile for that entity. The information on these pages is controlled by the user through their e-filing account. The Judiciary is not responsible for any content displayed on these pages and it is the sole responsibility of the user to maintain their profile correctly.

1.3.  Non-Personal Information – we collect non-personal data such as your IP address and usage patterns to understand how our portal is used and to improve our services.

2.     Service provision –  specific user information gathered during the filing of cases is not visible or accessible to any other user or registered user. We do not share personal information with third parties, except as necessary to provide our services or comply with legal obligations. 

3.     Our Protection of Your Data –  The Judiciary implements encryption and access controls to safeguard your data. We have the right to access your account and to use, modify, reproduce, distribute, display, and disclose your data solely to the extent necessary to provide the service in response to your support requests. You have the right to opt out of this grant of access permission at any time by contacting ictsupport@court.go.ke and requesting the same. We shall not (a) modify your data; or (b) access your data except as necessary to provide the Judiciary services, to prevent or address service or technical problems, or at your request in connection with your customer support matters.

 

4.    Disclosure

By registering with the Judiciary through the e-filing portal you can file and view the status of your cases and any pending actions required from you. The Judiciary will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required by law to do so.

5.     Right of Access

You have a right to be given a copy of your personal data retained by the Judiciary. If you require a copy of this information, please send a request in writing to ictsupport@court.go.ke with the subject “Access Request” in the subject bar. The request must originate from a registered company email account and for individuals the email should contain the individual’s national ID.

6.     Right of Rectification or Erasure

Should personal data held by us be found to be inaccurate, you have the right to have this data corrected. Where there is no legitimate reason for retaining your data, you have the right to have this data erased. If you require rectification or erasure of data, please send a request in writing to ictsupport@court.go.ke with “Rectification of Personal Data Request” or “Erasure of Personal Data Request” in the subject bar. The request must originate from a registered company email account and for individuals the email should contain the individual’s national ID.

7.    Cookies

7.1.  What are cookies – A cookie is a small computer software file that asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web applications can tailor their operations to your needs, likes, and dislikes by gathering and remembering information about your preferences and communicating with you appropriately.

7.2.  How we use cookies – We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our website to tailor it to customer needs. Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies.
