Terms and Conditions – Judiciary of Kenya
Section 1

Introduction

These Terms and Conditions ("Terms") govern the use of the Judiciary of Kenya's EFiling System ("System"). By registering and accessing the System, users agree to comply with these Terms, which may be updated periodically by the Judiciary.

Section 2

Definitions

User
Any individual or organization that accesses or uses the System.
Data
Any information provided by the user during registration or use of the System, including Personal Data.
Personal Data
Information that can be used to identify an individual including but not limited to name, contact details, email address, phone number, and case-related information.
Unauthorized Access
Access to the System without proper authorization or violating these Terms.
Section 3

Acceptance of Terms

By accessing or using the System, the user agrees to these Terms. If the user does not agree to the Terms, they must refrain from using the System.

Section 4

User Obligations

4.1 Registration

Users must provide accurate and truthful information during the registration process. Any attempt to provide false or misleading information is prohibited.

4.2 System Access

Users are responsible for maintaining the confidentiality of their login credentials and must not share them with third parties. The user is liable for all activities conducted under their account.

4.3 Proper Use

The System is to be used solely for filing legal documents, accessing case information, and other judicial processes as authorized by the Judiciary of Kenya. Unauthorized access or misuse of the System is prohibited and may result in suspension or termination of access.

Data Protection and Privacy

5.1 Compliance with Data Protection Laws

The Judiciary of Kenya is committed to protecting users' personal data in accordance with the Data Protection Act, 2019 of Kenya. The personal information provided by the user during registration and use of the System will be collected, processed, and stored in compliance with the law.

5.2 Data Collection and Use

Users agree that their personal data may be collected for the purposes of registration, authentication, system improvement, and legal compliance. The Judiciary may share personal data with relevant government agencies or judicial bodies when necessary for the administration of justice.

5.3 User Rights

Users have the right to:

  • Access their personal data held within the System.
  • Request corrections of inaccuracies.
  • Demand the deletion of their data where applicable, in accordance with the Data Protection Act.

5.4 Data Security

The Judiciary implements appropriate technical and organizational measures to protect users' personal data from unauthorized access, use, or disclosure. However, users acknowledge that no data transmission or storage system is completely secure.

Section 6

Intellectual Property Rights

All content and materials within the System, including but not limited to software, text, and images, are the intellectual property of the Judiciary of Kenya or its licensors. Unauthorized use, reproduction, or distribution of this content is strictly prohibited.

Suspension and Termination

The Judiciary reserves the right to suspend or terminate a user's account if they violate any provision of these Terms, misuse the System, or engage in any unlawful activity.

Section 9

Modifications to the System and Terms

The Judiciary reserves the right to modify or update the System or these Terms at any time. Users will be notified of significant changes through the System or by other appropriate means.

Section 10

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from the use of the System shall be resolved through judicial proceedings in Kenyan courts.
