DCJ closes appelate judges’ induction workshop

Deputy Chief Justice Philomena Mwilu closed the induction of the newly appointed Court of Appeal judges. The DCJ congratulated the judges on their appointment and underscored that preparation is personal and collegiality does not substitute for individual industry. She stated that persuasion is respectful and the judges must persuade their colleagues by reason, not insistence.
The Hon DCJ emphasised that institutional coherence matters and clarity of ratio strengthens a court more than multiplicity of voices. The Hon DCJ stated that restraint is strength and not every doctrinal opportunity requires expansion; not every controversy requires pronouncement beyond necessity.
She elaborated that humility is indispensable for Judges of Appeal who must remember that no legal reasoning is above the Constitution, nor beyond critique, nor immune from error. The Hon DCJ concluded that the oath the judges had recently taken must be their moral compass and a daily reminder that all judicial authority is held in public trust.
